Former Director of Public Prosecutions Mutembo Nchito is today expected to appear in court in a case in which he wants businessman Chanoda Ngwira to be cited for contempt of court.
This is on allegations that Ngwira interfered with the proceedings in the matter where Mr. Nchito is challenging his removal as DPP.
Ngwira wrote letters to Supreme Court Judges Mumba Malila and Albert Woods, in which he threatened to commence private criminal proceedings against the judges if they proceeded to give witness statements against the State to the character of Mutembo Nchito.
He further authored letters to the two justices which he later published on his Facebook page with the purpose of informing the nation and the public that the two judges had committed an offence by accepting to be witnesses against the state.
According to Ngwira the law demands that the two justices need to have clearance from Constitutional Court judges to tender their testimony.
But Mr. Nchito argues that Ngwira’s conduct is clearly contemptuous as it is meant to undermine the administration of justice and prevent witnesses from going to court.
